Privacy Policy

Perron Developments Pty Ltd and Perron Treeby Pty Ltd (collectively we, us, our) are committed to protecting the privacy of your personal information.  We are bound by the Privacy Act 1988 (Cth) (Privacy Act) and its Australian Privacy Principles (APPs).  This Privacy Policy explains how we manage your personal information (that is, information or an opinion, whether true or not, about an individual who is identified or is reasonably identifiable), including our obligations and your rights in respect of our dealings with your personal information. It also explains how you can contact us regarding the personal information that we hold about you.

This Privacy Policy describes what happens to personal information that we collect in the course of our business.  This includes your personal information that is collected via our website (at www.laketreeby.com.au) and in the course of our property development project at Lake Treeby Private Estate, in Treeby, Western Australia (Lake Treeby).

Our real estate agent: Land4Sale

As the property developers of Lake Treeby, we have appointed a real estate agent, Dimensions WA Pty Ltd ABN 45 120 653 938 trading as Land4Sale (Land4Sale), to market and arrange for the sale of the Lake Treeby properties.

As Land4Sale oversees the day-to-day management of property sales at Lake Treeby, Land4Sale will usually be the entity that collects your personal information when you make an enquiry.

Personal information collected, held, used or disclosed in relation to the marketing and selling of properties at Lake Treeby will be primarily handled by Land4Sale and may be disclosed to us.  We will then handle that personal information in accordance with this Privacy Policy.

Land4Sale deals with personal information collected in its capacity as real estate agent for the Lake Treeby development in accordance with its privacy policy, which can be found at www.land4salewa.com.au/privacy-policy (Land4Sale Privacy Policy).

What types of personal information do we collect?

Types of personal information we may collect include your name, address (including postal address), contact details (including email and phone numbers), billing information and your employment information.

When looking to purchase land at Lake Treeby, we may also collect personal information about your financial position (such as details about finance and funding status), lifestyle, cultural background and information required to verify your identity.

We may also collect and hold sensitive information about you, including your racial or ethnic origin.  We will only collect sensitive information about you if it is reasonably necessary for one or more of our functions or activities, and we will only do so with your consent, or otherwise in accordance with the Privacy Act.

Where you do not wish to provide us with your personal information, we may not be able to provide you with requested goods or services.

Collecting your personal information

We will collect and hold your personal information in a fair and lawful manner, and not in an intrusive way.  Where it is reasonably practical to do so, we will collect your personal information directly from you.  We may collect the personal information you directly give us through telephone, mail, email or a website contact form or if we otherwise deal with you in the course of our business.  We also use CCTV cameras at our premises for security purposes.

Generally, we will collect personal information about prospective purchasers in the Lake Treeby development from Land4Sale as the appointed sales agent.  This includes information you provide when you register an expression of interest to purchase a property or otherwise make an enquiry about our development at Lake Treeby, including through the website www.laketreeby.com.au.

In certain cases, we may also collect personal information from publicly available sources and third parties, such as suppliers, recruitment agencies, contractors, our clients and business partners.

If we collect personal information about you from a third party we will, where appropriate, request that the third party inform you that we are holding such information, how we will use and disclose it, and that you may contact us to gain access to and correct and update the information.

Our purposes for handling personal information

As a general rule, we only process personal information for purposes that would be considered relevant and reasonable in the circumstances.

To contribute to a sense of community in Lake Treeby, we may use your personal information (which may include sensitive information) to learn about the community, including using that information to develop metrics (such as aggregated statistics and identifying patterns).  We may use these metrics to inform events and as part of marketing campaigns.  Any direct marketing will be undertaken in accordance with the Privacy Act, the Spam Act 2003 (Cth) and this Privacy Policy.

We collect, hold, use and disclose your personal information to:

  • offer and provide you with our goods and services;
  • manage and facilitate the sale of property at Lake Treeby, as required as property developer of Lake Treeby and the seller of land and properties we make available for sale;
  • communicate with you, including in respect of any enquiries about or purchases of properties at Lake Treeby;
  • comply with our legal and regulatory obligations; and
  • otherwise manage our business.

Where permitted by the Privacy Act, we may disclose your personal information to our related organisations and Land4Sale, as the sales agent for Lake Treeby.  We may also disclose personal information to other third parties, such as professional advisers (lawyers, accountants or auditors), agents and external service providers (project managers and information technology service providers), regulatory bodies and government authorities as required to provide you with goods and services and as otherwise required by law.

If we disclose personal information to a third party, we generally require that the third party to take reasonable steps to protect that information.

We will not use or disclose your personal information for any other purpose unless you have consented to that use or disclosure, or the relevant use or disclosure is otherwise permitted by the APPs or some other law.

Overseas Disclosure

From time to time, we may engage an overseas service provider to assist us, such as cloud-based storage solutions, email marketing platforms and other technology providers.  It is not possible to say definitively each country that may be involved, but many of these technology providers are likely to be based in the United States of America.  By providing your personal information to us, you consent to us disclosing your personal information to any such overseas recipients for purposes necessary or useful in the course of operating our business, and agree that APP 8.1 will not apply to such disclosures.  For the avoidance of doubt, in the event that an overseas recipient breaches the Australian Privacy Principles, that entity will not be bound by, and you will not be able seek redress under, the Act.

As at the date of this Privacy Policy, we are not likely to otherwise disclose your personal information overseas.  If in future we do propose to disclose personal information overseas in other circumstances, we will do so in compliance with the requirements of the Privacy Act.  We will, where practicable, update this Policy to list countries in which any overseas recipients are likely to be located.

Security of your personal information

We hold personal information in both paper-based and electronic files.  We may store electronic files in our cloud storage, and in some cases, on third party servers, which may be located overseas.

We have appropriate physical, electronic and managerial security measures in place to prevent unauthorised access or disclosure of the personal information we hold. These measures include access controls to our premises and IT security for our electronic data. Our personnel are only permitted to access information as necessary for their duties.

We will destroy or de-identify personal information once it is no longer needed for a valid purpose or required to be kept by law.  CCTV footage captured at our premises is only stored for a limited period of time before it is automatically deleted.

Direct Marketing

We may stay in touch with customers and let them know about new opportunities, including by contacting customers through our agent, Land4Sale.  We may provide you with information about new goods, services and promotions either from us, or from third parties which may be of interest to you.

Provided that you have not unsubscribed or otherwise opted out, we may use your information for direct marketing:

  • where you have agreed to receive direct marketing from us;
  • where you have engaged with us directly, and we believe that you would reasonably expect to receive direct marketing from us; and
  • otherwise in accordance with the Privacy Act and the Spam Act 2003 (Cth), as applicable.

We will not use sensitive information for direct marketing without your consent.  We may seek your consent to this via Land4Sale when you complete forms provided by Land4Sale.

We may utilise the services of third parties to assist us with undertaking our direct marketing activities.  We will not otherwise disclose your personal information to third parties for marketing purposes without your consent.

You may opt out at any time if you no longer wish to receive commercial messages from us.  You can make this request by contacting our Privacy Officer.

Note that if you opt-out of direct marketing messages from us, we may still communicate with you from time to time for other purposes, including where we:

  • respond to any correspondence you send us;
  • provide you with updates in respect of any goods or services or any property you are purchasing or have purchased in Lake Treeby;
  • engage with our contractors and suppliers; or
  • are legally required to provide you with notice of certain matters.

Cookies

A cookie is a small text file stored in your computer’s memory or on your hard disk for a pre-defined period of time.  We use cookies to identify specific machines in order to collect aggregate information on how visitors are experiencing our website.  This information will help to better adapt our website to suit personal requirements.  For information on cookie settings of your internet browser, please refer to your browser’s manual.

Automated Decision Making

We may use computer programs to make, or assist our human-decision makers to make, decisions that might affect your rights or interests.

At this time, we do not use computer programs to make decisions which could reasonably be expected to significantly affect the rights or interests of individuals.  Similarly, we do not use computer programs to assist us is making those kinds of decisions in a manner which is substantially and directly related to the decision-making process.

We may use computer programs:

  • to make decisions, or substantially and directly assist us to make decisions, which would not reasonably be expected to significantly affect the rights or interests of individuals; and
  • to assist our human decision makers, where such computer programs do not substantially and directly relate to making decisions.

Accessing and correcting your personal information

You have a right to request access to the personal information we hold about you by contacting our Privacy Officer using the details set out below. In some cases, we may refuse a request, in which cases we will notify you in writing stating the reasons for refusing access.

If you believe that any information we are holding on you is incorrect, out of date, irrelevant or incomplete, please contact using the details set out below. We are not required to correct personal information if we do not agree that it requires correction.  If we refuse a correction request, we will provide you with a written notice stating our reasons for refusing.

We will respond to all requests for access to or correction of personal information within a reasonable time.

If your request relates to information held by Land4Sale, you will need to make a request to Land4Sale as set out in the Land4Sale Privacy Policy.
